Fitmarto

Seller terms

For businesses selling products in the Fitmarto shop — who sells, what we check, what we keep, and when you are paid.

Version 2026-10a · In effect since 21 October 2026

These terms are the agreement between your business and Fitmarto (to be confirmed), Address to be confirmed, for selling in the Fitmarto shop. You accept them when you send your shop to us for checking, and again each time they change. Our Terms of use and Privacy policy apply as well.

Who sells what

You are the seller. Each product is sold by your business to the customer: your legal name, address and GSTIN are on the product page and on the invoice, and you are responsible for the product itself — that it is what the page says, safe, legal to sell, in date and packed properly.

Fitmarto is the marketplace. We list your products, take the payment on your behalf, pass the order to you, and pay you what is yours.

What we check before you sell

  • Your business: legal name, GSTIN and PAN, and the state you ship from. A GSTIN that does not match the PAN or the state is sent back.
  • Food, protein and supplements need a current FSSAI licence. Those products come off sale by themselves the day the licence runs out, and back on when you add the renewed one.
  • Every product, before it goes on sale, and every change to it afterwards, the price included. While a change waits for us, customers keep seeing — and buying — the version we approved last. Stock and pausing a product are yours to change at any time.

We can send something back with a reason, and we can take a live product down — for example if it breaks the law or the product page is misleading. We tell you why.

What a product page must say

The name, brand, a true description and photos of the actual product; the MRP and your price, which can never be above the MRP; the manufacturer or packer, the country of origin and the net quantity; for food, the veg or non-veg mark, ingredients, allergens and nutrition; for clothing, a size chart. These are the law (Legal Metrology, the Consumer Protection (E-Commerce) Rules 2020 and FSSAI labelling), not our preference.

Orders and delivery

  • You pack and ship each order yourself, within the days you promise on the product (at most 7). You add the courier and tracking number when you ship; the customer sees them.
  • An order not shipped within 7 days of payment is cancelled and the customer refunded in full.
  • You can cancel an order before it ships, with a reason — for example if something is out of stock. The customer is refunded in full.
  • An order counts as delivered when you or the customer say so, or 14 days after shipping if nobody does.

Returns and refunds

The customer can cancel for a full refund until the order ships. After delivery, a refund is only for an item that arrived damaged, wrong or missing, reported within 7 days with photos. You can reply to the report; our team decides, and a refund we decide on comes out of what we would have paid you for that order. Opened food and supplements cannot be returned. The full rules for customers are in the Refund policy.

What we keep, and when you are paid

  • Commission: a percentage of everything the customer paid you for an order — items and delivery. Your rate is set when we approve you and shown on your dashboard. If we change it, we tell you, and it applies only to orders placed after the change.
  • Tax we hold back: as the marketplace, we must collect GST TCS and deduct income-tax TDS on your sales and pay them to the government in your name. They are shown against every order and you can claim them back through your own returns.
  • When: what you are owed for an order becomes payable 7 days after it is delivered — the return window — as long as no problem report on it is still open. We pay to the bank account on your dashboard and show the bank reference.
  • If we refund a customer after paying you, we take that amount off your next payout.

We send you a monthly invoice for our commission, with GST on it.

Customer details

We give you the customer's name, delivery address and phone number so you can deliver the order. Use them for that and nothing else — no marketing, no sharing, and delete them once the order and any return are over, except what tax law makes you keep.

Ending this

You can close your shop from your account once every order is delivered or cancelled and we have paid you what is owed. We can pause or close a shop that breaks these terms; orders already paid are completed or refunded first.

Changes, and the law

We may change these terms. If the change matters, we tell you before it applies, and you accept it again before your next product goes on sale. These terms are governed by the law of India.
