Fitmarto

Terms of use

What we do, what your trainer does, what you agree to, and who is responsible for what.

Version 2026-10a · In effect since 21 October 2026

These terms are the agreement between you and Fitmarto (to be confirmed), Address to be confirmed, for using Fitmarto — the apps and the website. By signing in you accept them. If you do not, do not sign in.

What this is

Fitmarto is a place where people find a personal trainer, buy coaching, and do the training. We are not your trainer. The coaching itself is an agreement between you and whoever sold it to you. We run the software, take the payment on the seller's behalf, and keep everybody honest with each other.

We check the certificates a trainer uploads before listing them. That is a check, not a guarantee, and not a recommendation of any particular coach.

Some trainers coach on their own; others coach at a gym. A gym here is a business that registered with us and that we checked. When your trainer coaches at a gym, the gym is the seller: it sets the price, it is paid, and the invoice comes from it. It sees what the Privacy policy lists, and nothing about your body.

Training is not medical advice

Nothing in this app is medical advice, a diagnosis, or a treatment. Your trainer is a fitness coach, not your doctor.

Before you start, answer the health questionnaire honestly — it exists so your trainer knows what not to ask of you, and a plan cannot be published to you until it is answered. If you have a condition, an injury, are pregnant, are on medication, or you are simply unsure, talk to a doctor first. Stop if something hurts, and get it looked at.

Exercise carries risk. You take that risk on yourself.

Your account

You must be 18 or older, and you must be a real person giving real details. The sign-in code that arrives on your phone is yours alone — anybody who has it can get into your account. One account per person. Tell us straight away if you think someone else is in it.

If you are a trainer

  • Hold the qualifications and insurance you claim, and keep them current. Upload real documents; a forged one ends the account.
  • What you learn about a client's health is theirs, not yours to repeat.
  • On your own: you set your prices, and we check each price before members can buy. A change goes live once we approve it; until then the old price stays.
  • At a gym: the gym sets the price of everything you sell here and is paid for it. How the gym pays you is between you and the gym, outside the app.
  • Deliver what you sold.
  • You are an independent professional, not our employee, agent or partner. You are responsible for your own tax, your own registrations and your own advice to clients. We do not supervise how you coach.
  • Sharing your page with clients you already have is exactly what this is for.
  • If you join a gym here, it sees your clients' names, their bookings and what they paid since you joined — never their health data or messages. Your clients are told. You can leave whenever you like, and your clients stay yours; your offers pause until you set your own price and we approve it.

If you run a gym

  • The gym dashboard itself costs nothing. We keep 20% of each sale made through it, as with every sale here. If that ever changes, we tell you at least 30 days before, and you can close the account instead.
  • The details you register must be true, and you must be entitled to act for the gym. We check them before trainers can find it; that is a check, not an endorsement.
  • What the dashboard shows you about members — names, bookings, attendance, payments — is shown to you to run the gym, and for nothing else. No marketing lists, no passing it on, and no contacting members because of it.
  • You set the price of everything your trainers sell here, and it goes live when you set it. You are the seller: the invoice carries your gym's legal name, and the money is paid to your bank account, less our 20%. Until you add a bank account, your trainers' offers cannot be bought.
  • How you pay your trainers is between you and them, outside the app.
  • Do not ask members to pay at the counter for coaching or sessions that are sold here.
  • We can pause a gym that breaks these terms, or that we receive serious complaints about, and we will tell you why.

Money

We keep 20% of every payment, from solo trainers and gyms alike. It is worked out and recorded at the moment of the sale, and the seller sees it in their earnings.

The seller is the trainer, if they coach on their own, or the gym they coach at. The invoice names the seller, and we collect the payment on the seller's behalf. Who is paid is fixed on the day you pay: if your trainer changes gym later, that payment does not move.

Monthly coaching is paid month by month and nothing renews by itself — you will be reminded before it lapses, and if you do nothing it simply stops.

Refunds have their own page: Refund policy.

The shop

The Shop sells gym equipment, training wear, protein, supplements and packaged food from businesses we have checked. Each product is sold by the business named on its page — the seller — not by us: their legal name, address, GSTIN and customer-care contact are on the product page and on the invoice, and they are responsible for the product itself. We check every product and every change to it before it goes on sale, take the payment on the seller's behalf, and step in when something goes wrong.

  • What you pay is the price shown when you pay, delivery included. If a price or the stock changes while the cart sits on your phone, you are shown the new total before anything is charged.
  • One order can hold several sellers. Each ships its part on its own, with its own courier and tracking number, and its own invoice.
  • You can cancel any part that has not shipped yet for a full refund.
  • After delivery, refunds are for items that arrived damaged, wrong or missing, as the Refund policy sets out.
  • The seller ships within the days shown on the product, and at most 7 days after you pay; if they do not, the order is cancelled and refunded for you.

Complaints about an order go to support@fitmarto.com or our grievance officer, To be confirmed; we answer within 3 working days and resolve them within a month. Businesses that sell here accept the Seller terms as well as these.

Food data

The calorie and nutrient numbers in the Food tab come from the Indian Nutrient Databank (Vijayakumar et al., 2024), from USDA FoodData Central, and from the foods you enter yourself. Your calorie budget is an estimate worked out with a standard formula from what you told us. It is not medical or dietetic advice; if you have a condition that food affects, follow your doctor or dietitian instead.

Live sessions

One-to-one sessions are never recorded — not by us, not by your trainer. In a group class the trainer can see and hear whoever has switched a camera on, other members cannot, and you start muted with your camera off. If a class is going to be recorded, you are told before it starts.

What your content stays

Your logs, your measurements and your photos are yours. By using the app you let us store them and show them to the trainer you chose — and, only as far as the Privacy policy lists, to the gym they coach at — nothing more. Plans and diet plans a trainer writes stay the trainer's work; you may use them, not resell them.

What ends an account

Lying about your health in a way that puts you or a trainer at risk. Abuse or harassment of anybody. Faking certificates or reviews. Trying to take payments outside the app to dodge commission (a gym and its trainers settling up between themselves is not that). Attacking, scraping or reverse-engineering the service. Using it for anything illegal.

We can suspend an account for any of these, and we will tell you why.

What we do not promise

We work hard to keep the service up, and we do not promise it always will be. Plans, prices and features change. We are not responsible for what an independent trainer does or fails to do, for injuries from training, or for losses we could not reasonably have seen coming. Where the law lets us limit what we owe you, our total liability is limited to what you paid us in the three months before the problem — and nothing here takes away rights consumer law gives you that cannot be signed away.

Ending it

Close your account whenever you like, from Profile. Either side can end a coaching at any time; when it ends, health sharing and the chat close immediately, and any unfinished, unused part of what you paid for is dealt with under the Refund policy.

Law

These terms are governed by the law of India, and the courts of Chennai have jurisdiction. If any part of this is unenforceable, the rest still stands.

Changes

We change the version at the top and the date it takes effect, and we tell you in the app when a change matters. Carrying on using the service after that is how you accept it.
